In 2009, Denmark issued Order No. 855 dated 05/09/2009 to limit phthalates to no more than 0.05% in toys and children’s products intended for children aged 0 to 3 years. This order did not cover Benzyl Butyl Phthalate (BBP), Di-n-butyl Phthalate (DBP), Bis-(2-ethylhexyl) Phthalate (DEHP), Diisobutyl Phthalate (DIBP), Di-isononyl Phthalate (DINP), and Di-n-octyl Phthalate (DNOP) as these six phthalates were regulated by EU legislation.
In March 2018, the European Union (EU) published Regulation (EU) 2018/2005, replacing entry 51 of Annex XVII of Regulation (EC) 1907/2006 concerning the Registration, Evaluation, Authorisation, and Restriction of Chemicals (REACH Annex XVII). This legislative act includes provisions to limit BBP, DBP, DEHP, and DIBP in toys and children’s products.
As of July 7, 2020, toys and children’s products must comply with these four phthalates when placed on the EU market (SafeGuards 2/19).
In June 2020, the Danish Ministry of Environment and Food further issued Order No. 947 dated 20/06/2020 to limit phthalates to no more than 0.05% in toys and children’s products for children aged 0 to 3 years. According to the definitions in the new order:
- Toys are products designed and intended exclusively or partially for use by children aged 0-3 years (0-36 months) during play.
- Childcare articles are products intended or normally intended to be placed in the mouth by children aged 0-3 years (0-36 months), including pacifiers, jewelry, and bath equipment, etc.
- Phthalates are esters of phthalic acid.
The new order came into effect on July 1, 2020, and repealed Order No. 855 dated 05/09/2009.
