Significant updates from the U.S. Senate: the recently passed Law 8214 imposes new restrictions on flame retardants in various sectors including furniture, electronics, and children’s products. This legislation prohibits the sale of new children’s products, mattresses, or upholstered furniture containing any identified flame retardant chemicals at levels exceeding 1,000 parts per million (ppm). Starting January 1, 2023, this ban will also apply to electronic displays containing organohalogen flame retardant chemicals.
The law outlines specific restrictions, such as those related to the electronic components of regulated materials, mattress seams, and non-foam components of adult mattresses.
Violations of these restrictions will result in significant penalties, with civil fines up to $1,000 per day for the first offense and up to $2,500 per day for subsequent offenses.
Affected Products:
- Electronic Displays (including video display devices)
- Furniture
- Mattresses and Mattress Fillings
- Toys/Children’s Products
- Upholstery
