{"id":8845,"date":"2025-08-27T09:28:23","date_gmt":"2025-08-27T07:28:23","guid":{"rendered":"https:\/\/analytical-group.com\/?p=8845"},"modified":"2025-09-09T09:31:59","modified_gmt":"2025-09-09T07:31:59","slug":"france-new-rules-on-pfas","status":"publish","type":"post","link":"https:\/\/analytical-group.com\/en\/news-en\/france-new-rules-on-pfas","title":{"rendered":"France: new rules on PFAS"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"8845\" class=\"elementor elementor-8845 elementor-8844\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-25c4b897 e-flex e-con-boxed e-con e-parent\" data-id=\"25c4b897\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-6b28635 elementor-widget elementor-widget-text-editor\" data-id=\"6b28635\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"90\" data-end=\"503\">On August 7, 2025, the French Ministry of Ecological Transition launched two public consultations on draft decrees implementing Law No. 2025-188 of February 27, 2025, known as the <strong><em data-start=\"278\" data-end=\"290\">\u201cPFAS Law\u201d<\/em>.<\/strong><br data-start=\"291\" data-end=\"294\" \/>This represents a crucial step in the national strategy to reduce and eliminate per- and polyfluoroalkyl substances (PFAS), with direct implications for several industries and for the entire European market.<\/p><h3 data-start=\"510\" data-end=\"547\">Ban on PFAS in consumer products<\/h3><p data-start=\"549\" data-end=\"740\">The law introduces a ban on the production, import, export, and placing on the market of certain products containing PFAS. The first implementing decree clarifies the scope, establishing:<\/p><ul data-start=\"742\" data-end=\"1796\"><li data-start=\"742\" data-end=\"891\"><p data-start=\"744\" data-end=\"891\"><strong data-start=\"744\" data-end=\"766\">Definition of PFAS<\/strong>: aligned with the OECD (2021) definition, i.e. any substance containing at least one fully fluorinated \u2013CF\u2082 or \u2013CF\u2083 group.<\/p><\/li><li data-start=\"892\" data-end=\"984\"><p data-start=\"894\" data-end=\"984\"><strong data-start=\"894\" data-end=\"917\">Affected categories<\/strong>: textiles, footwear, cosmetics, waxes, and waterproofing agents.<\/p><\/li><li data-start=\"985\" data-end=\"1065\"><p data-start=\"987\" data-end=\"1065\"><strong data-start=\"987\" data-end=\"1007\">Actors concerned<\/strong>: manufacturers, importers, distributors, and suppliers.<\/p><\/li><li data-start=\"1066\" data-end=\"1438\"><p data-start=\"1068\" data-end=\"1118\"><strong data-start=\"1068\" data-end=\"1115\">Permitted residual concentration thresholds<\/strong>:<\/p><ul data-start=\"1121\" data-end=\"1438\"><li data-start=\"1121\" data-end=\"1198\"><p data-start=\"1123\" data-end=\"1198\">25 ppb for each PFAS measurable by targeted analysis (excluding polymers)<\/p><\/li><li data-start=\"1201\" data-end=\"1264\"><p data-start=\"1203\" data-end=\"1264\">250 ppb for the sum of PFAS (including degraded precursors)<\/p><\/li><li data-start=\"1267\" data-end=\"1438\"><p data-start=\"1269\" data-end=\"1438\">50 ppm for polymeric PFAS<br data-start=\"1294\" data-end=\"1297\" \/>These limits are in line with current analytical detection capabilities and may be updated in light of scientific and technical progress.<\/p><\/li><\/ul><\/li><li data-start=\"1439\" data-end=\"1603\"><p data-start=\"1441\" data-end=\"1603\"><strong data-start=\"1441\" data-end=\"1475\">Initial exemptions (from 2026)<\/strong>: personal protective equipment (PPE) regulated under Regulation (EU) 2016\/425 and waterproofing products for PPE maintenance.<\/p><\/li><li data-start=\"1604\" data-end=\"1796\"><p data-start=\"1606\" data-end=\"1796\"><strong data-start=\"1606\" data-end=\"1642\">Long-term exemptions (from 2030)<\/strong>: technical industrial textiles, medical textiles, and products essential for healthcare or national sovereignty, where no PFAS-free alternatives exist.<\/p><\/li><\/ul><h3 data-start=\"1803\" data-end=\"1859\">\u00a0<\/h3><h3 data-start=\"1803\" data-end=\"1859\">Progressive reduction of industrial PFAS discharges<\/h3><p data-start=\"1861\" data-end=\"1953\">The second decree focuses on industrial wastewater containing PFAS.<br data-start=\"1928\" data-end=\"1931\" \/>The targets set are:<\/p><ul data-start=\"1955\" data-end=\"2102\"><li data-start=\"1955\" data-end=\"2037\"><p data-start=\"1957\" data-end=\"2037\"><strong data-start=\"1957\" data-end=\"2035\">\u201370% reduction of emissions (compared to 2023 levels) by February 27, 2028<\/strong><\/p><\/li><li data-start=\"2038\" data-end=\"2102\"><p data-start=\"2040\" data-end=\"2102\"><strong data-start=\"2040\" data-end=\"2100\">Complete elimination of PFAS discharges by February 2030<\/strong><\/p><\/li><\/ul><p data-start=\"2104\" data-end=\"2240\">This roadmap builds on a 2023 monitoring campaign, which revealed the presence of PFAS in about half of the industrial sites analyzed.<\/p><p data-start=\"2242\" data-end=\"2525\">The draft aims to fill gaps in French law, which until now had only limited provisions covering PFOS (25 \u00b5g\/l in effluents from authorized ICPE sites). The new scheme foresees a broader approach, potentially applying to all industrial sites, including those not classified as ICPE.<\/p><p data-start=\"2527\" data-end=\"2760\">It also introduces an economic disincentive mechanism: a fee of \u20ac100 for every 100 grams of PFAS discharged into water by authorized facilities (the list of substances subject to the fee will be specified in a separate decree).<\/p><h3 data-start=\"2767\" data-end=\"2786\">\u00a0<\/h3><h3 data-start=\"2767\" data-end=\"2786\">Future outlook<\/h3><p data-start=\"2788\" data-end=\"3086\">France positions itself among the most ambitious European countries in tackling PFAS, setting strict limits for consumer products and binding targets for industrial wastewater reduction.<br data-start=\"2974\"
