The law identifies a specific industrial model, based on precise criteria, and attaches targeted obligations and penalties to it.<\/div><div data-block-id=\"block-UmFmuYBHpP\">\u00a0<\/div><h5 class=\"ql-block\" data-block-id=\"block-minDG4i2MQ\"><strong>Is France really the first?<br \/><\/strong><\/h5><div class=\"ql-block\" data-block-id=\"block-mkLfzuQz7-\"><strong>Yes, with one caveat.<\/strong> It is not the first country with environmental rules applicable to fashion, EPR textile schemes, environmental information obligations, and rules on waste, chemical substances and due diligence already existed.<\/div><div data-block-id=\"block-mkLfzuQz7-\">\u00a0<\/div><div class=\"ql-block\" data-block-id=\"block-mkLfzuQz7-\">What&#8217;s new is that the<strong> Loi n\u00b0 2026-602 is the first national law to specifically target the ultra-fast fashion model,<\/strong> rather than fashion sustainability in general. This was confirmed by the Assembl\u00e9e nationale in the debate of 24 June 2026, and the Ministry for Ecological Transition described the text as &#8220;pionnier en Europe.&#8221;<\/div><h5 class=\"ql-block\" data-block-id=\"block-ecxc2jbfVR\"><strong>The two criteria<\/strong><\/h5><div class=\"ql-block\" data-block-id=\"block-Qt57of-Tym\">Article<strong> L.541-9-1-1<\/strong> of the Code de l&#8217;environnement defines ultra-fast fashion by looking at the effect of a producer&#8217;s practices on a product&#8217;s useful life, linked to two combined elements.<\/div><ul><li class=\"ql-block\" data-block-id=\"block-m4Xh68jsTL\"><strong>Volume: <\/strong>a high number of new references placed on the market. What counts is not the low price, the number of collections, or the speed of the production cycle, but the<strong> number of new references<\/strong>. <br \/>The threshold is not set by the law itself, but is left to a d\u00e9cret en Conseil d&#8217;\u00c9tat, to be assessed by brand and by sales channel.<br \/><br \/><\/li><li class=\"ql-block\" data-block-id=\"block-YEVZYwetv5\"><strong>Low incentive to repair<\/strong>\u00a0this is not a technical test of a garment&#8217;s durability, but the consequence of commercial practices on the product&#8217;s useful life: the <strong>availability<\/strong> and <strong>accessibility<\/strong> of repair services, their <strong>cost-effectiveness compared with replacement, and the information provided to consumers<\/strong>. L.541-9-1-1 is required.<\/div><div data-block-id=\"block-edckjDB5RH\">\u00a0<\/div><h5 class=\"ql-block\" data-block-id=\"block-pTHElzSAH4\"><strong>Marketplaces and online platforms<\/strong><\/h5><div class=\"ql-block\" data-block-id=\"block-6UfeNA0YH1\">The assessment extends to <strong>marketplaces<\/strong>, <strong>platforms<\/strong> and <strong>portals<\/strong> that enable remote sales or delivery. For these operators, the practice is assessed based on the full set of new references offered through the interface, subject to documented exclusions provided for certain third-party brand references.<\/div><div data-block-id=\"block-6UfeNA0YH1\">\u00a0<\/div><h5 class=\"ql-block\" data-block-id=\"block-bibcxC5qFm\"><strong>Mandatory information for consumer<\/strong><\/h5><div class=\"ql-block\" data-block-id=\"block-Q-FxGCZir5\">Online interfaces that fall under the ultra-fast fashion category will have to display messages encouraging moderation, reuse and repair, informing about the product&#8217;s social impact and environmental impact including delivery. The content and format will be defined by decree.<\/div><div data-block-id=\"block-Q-FxGCZir5\">\u00a0<\/div><div class=\"ql-block\" data-block-id=\"block-Iijvqfkmt4\">For textile products sold online, <strong>places of manufacture<\/strong> must be clearly indicated, in the same font size used for the price and placed near it.<\/div><div data-block-id=\"block-Iijvqfkmt4\">\u00a0<\/div><h5 class=\"ql-block\" data-block-id=\"block-zcLqqRbNHw\"><strong>EPR and eco-contributions: the new malus<\/strong><\/h5><div class=\"ql-block\" data-block-id=\"block-pqk3qFeM3d\">The law amends the French extended producer responsibility (REP\/EPR) system for textiles, introducing a modulation also linked to range breadth, frequency of offers, and incentive to repair.<\/div><div class=\"ql-block\" data-block-id=\"block-pqk3qFeM3d\">When the modulation becomes a penalty, the tiers per product are:<br \/><br \/><\/div><table class=\"ql-table-embed-table\" style=\"height: The mechanism takes effect on <strong>1 September 2026<\/strong>.<\/div><div data-block-id=\"block-0qQnTASucz\">\u00a0<\/div><h5 class=\"ql-block\" data-block-id=\"block-AWrqFr6dQk\"><strong>Advertising and influencer marketing<\/strong><\/h5><div class=\"ql-block\" data-block-id=\"block-ZwHxuWAQcY\">From <strong>1 January 2027<\/strong>, advertising of ultra-fast fashion products and the promotion of brands that use this model will be banned. The use of the term &#8220;gratuit&#8221; (free) as a promotional lever for these products will also be banned. The ban extends to influencers, for paid, free or in-kind activities: violations can result in an administrative fine of up to <strong>\u20ac100,000.<\/strong><\/div><div data-block-id=\"block-ZwHxuWAQcY\">\u00a0<\/div><h5 class=\"ql-block\" data-block-id=\"block-Ywp__jd7J8\"><strong>Operators not established in France<\/strong><\/h5><div class=\"ql-block\" data-block-id=\"block-U9DjG2kvLL\">An entity not established in France but subject to French EPR obligations must appoint, through a written mandate, a representative established in France responsible for compliance with REP\/EPR obligations, except in cases where the law considers the obligation already fulfilled.<\/div><div data-block-id=\"block-U9DjG2kvLL\">\u00a0<\/div><div class=\"ql-block\"
